AdcpXP is available under the following conditions
To obtain the software read the
license agreement below and fill out
the attached application form. This is your electronic signature certifying
that you agree to the terms and conditions of the license.
Conditions
This software, any accompanying documentation and other
relevant information (collectively "Information") was developed by Dongsu
Kim, Marian Muste, Larry Weber, Kwonkyu Yu, and Ryan Asman at The University
of Iowa. You ("User") should be aware of the following statements and
declarations. If these are agreeable, please fill out the Application Form,
and click the "I Agree" button. This software is a beta-version
free of charge. No extensive support is provided for the software, but
comments on deficiencies or further developments are welcome. The current
software version will expire on 28 February 2009. A new version using the
testers’ input will be released afterwards.
The IIHR team and The University of Iowa ("the University") retain all
right, title and interest to the Information, ideas, concepts, techniques,
algorithms, written documentation, and all copies thereof, arising from the
Information and which is provided herein.
The User shall not remove any proprietary, copyright, trade secret or other
legend from any form of the Information. The User shall not copy or
reproduce in whole or in part the Information, except to accomplish the
purposes of any agreements, without the written permission of Marian Muste
and the University.
In no event shall the User reverse engineer, disassemble, reverse assemble
or in any way use the Information, for any commercial purpose, including the
enhancement of its own software or that of third parties, or for any other
purpose not set forth in this letter agreement, without the express, written
consent of Muste and the University.
THE INFORMATION IS PROVIDED "AS IS" AND WITHOUT ANY WARRANTY OF ANY KIND,
EXPRESS OR IMPLIED, REGARDING THE ACCURACY OF THIS INFORMATION, INCLUDING
THE IMPLIED WARRANTY OF MERCHANTIBILITY AND FITNESS FOR A PARTICULAR
PURPOSE. NEITHER MUSTE NOR THE UNIVERSITY ACCEPTS RESPONSIBILITY FOR ANY
EXPENSE, LOSSES OR ACTION INCURRED OR UNDERTAKEN BY THE USER AS A RESULT OF
THE RECEIPT OF THE INFORMATION. NEITHER MUSTE NOR THE UNIVERSITY SHALL BE
RESPONSIBLE FOR ANY SPECIAL, INCIDENTAL, CONSEQUENTIAL OR INDIRECT DAMAGES,
LOSS OF USE, LOSS PROFITS OR ANY OTHER LOSS OR DAMAGE ARISING OUT, RESULTING
FROM OR IN ANY WAY ASSOCIATED WITH THE USER'S USE, ACCESS TO OR POSSESS OF
THE INFORMATION.
Neither Muste nor the University grants any license or other right under any
copyrights, patents, trademark or trade secret by disclosure and provision
of this Information to the User pursuant to this Agreement.
This Agreement shall be governed by the laws of the State of Iowa and shall
not be modified or changed in any manner except in writing and signed by all
parties.
